WHAT OFFICIAL COURT DOCUMENTS SUPPORT YOUR SUCCESSFULL WAIVER APPLICATION AND WHERE TO GET THEM

2. Court Documents for each and every crime you have committed will have to be gathered and submitted with your waiver application.

Form C-480, which you will receive from the R.C.M.P. will list EACH & EVERYconviction on your criminal record. If you remember your convictions, you don't have to wait till you receive this confirmation.

In either case, you will need the OFFICIAL COURT DOCUMENTS relating to your convictions.


***IF YOU HAVE A PARDON***

You will have to take an EXTRA STEP because your file is "sealed" and no one is allowed to access it. That is probably why you got a pardon in the first place wasn't it?

First, determine the jurisdiction of the Court of conviction. Were you convicted in a Municipal Court, a Provincial Court, Superior Court or in Federal Court? What province and what city? Once you have determined which Court has your records, you will need to contact the Court and tell the clerk what you need. This can be done by fax, by mail or in person.

I always like to phone them first. I ask for the clerk of the criminal division. That way, I have a name that I can send my fax or written request to.

ASK FOR THESE DOCUMENTS:

Certified copy of the "Information" or "Indictment;

Certified copy of the "minutes" showing the disposition of your case;

Official record of conviction and any other documents relating to commutation of sentence, parole, probation or pardon.

All documents have to be submitted in English. You have the right to ask that these documents be translated into English so make sure that you avail yourself of this right! If you fail to do this, you will have to have them translated at your own expense.

HERE is the EXTRA STEP that you need to take in order to allow the Courts to unseal your records.

You must contact the National Parole Board of Canada and THEY will authorize the Courts to divulge the content of your criminal record.

THEORETICALLY, your files are not to be divulged to anyone, including yourself. But, since we are dealing with public servants, some of which are more knowledgeable than others, the rules are not always followed in a uniform manner. Some jurisdictions interpret the Law differently and have been known to be more accommodating than others.

If you feel lucky, call them, sweet talk them and see if they will be willing to cut corners. Chances are that they will want you to go through official channels.

Your PARDON DOCUMENTS contain all the information you need. If you don't have them, your C-480, (the form that the RCMP will send you) has this information

The National Parole Board will send you a copy of the letter of authorization that they have sent to the various Courts where you have been convicted.
